Online Shopping Refund Not Received? What to Do and How to File a Consumer Complaint in India

You returned a product after the seller approved the return, but the refund has still not reached your bank account. Or perhaps you received a wrong, defective or damaged product and the online seller is repeatedly delaying the refund.

Online shopping refund disputes are becoming a common consumer problem. However, before immediately filing a court case, it is important to preserve evidence and follow a proper grievance process.

Depending on the facts, consumer remedies may arise under the Consumer Protection Act, 2019 and the applicable consumer e-commerce framework. The exact legal remedy can depend on the transaction, the role of the seller or platform, the terms of purchase and the available evidence.

Common Online Shopping Refund Problems

An online shopping dispute may arise before delivery, after delivery or after the product has been returned.

  • Refund approved but money not received.
  • Product returned but refund is repeatedly delayed.
  • Wrong product delivered.
  • Damaged or defective product received.
  • Replacement promised but not provided.
  • Seller or company stopped responding.
  • Refund was shown as processed but not reflected in the payment account.
  • Return pickup was completed but the company denied receiving the product.

Every refund dispute is not automatically a criminal case or fraud. In many situations, the dispute may primarily involve consumer rights, contractual obligations or service-related issues.

Step 1: Check Whether the Refund Has Actually Been Processed

Before taking legal action, carefully check the order page, refund status, emails and payment account.

If the company says that the refund has already been processed, preserve the refund reference number or transaction reference, if provided. Then check the relevant bank account, card statement, UPI transaction history or original payment method.

Take screenshots, but also preserve original emails and transaction records where possible.

Step 2: Preserve These Important Documents

Evidence can play an important role in a consumer dispute. Before deleting anything, save the relevant records.

  • Invoice or purchase bill.
  • Order confirmation.
  • Payment receipt or transaction record.
  • Product photographs or videos, where relevant.
  • Return request confirmation.
  • Courier or pickup proof.
  • Delivery confirmation of the returned product.
  • Refund approval email or message.
  • Refund reference number.
  • Emails and chats with the company.
  • Customer-care complaint numbers.

If your product was defective, warranty records and service-centre documents may also be important.

Electronic records such as emails, messages and digital transaction records should be preserved carefully. Their legal treatment can depend on the facts and applicable law. For current matters, the Bharatiya Sakshya Adhiniyam, 2023 is part of the present evidence-law framework.

Step 3: Send a Clear Written Complaint to the Company

Do not rely only on repeated telephone calls. A written complaint can create a useful record of your grievance.

Your complaint should clearly mention:

  • Order number.
  • Purchase date.
  • Amount paid.
  • Date of return, if applicable.
  • Nature of the problem.
  • Previous complaint details.
  • The remedy you are requesting.

Keep the communication factual and clear. Avoid unsupported allegations or unnecessary threats.

Step 4: Consider the National Consumer Helpline

Consumers may use the National Consumer Helpline (NCH) for consumer grievances at the pre-litigation stage. The official NCH system provides multiple channels for registering consumer grievances and uploading relevant information.

The grievance process may help bring the issue to the attention of the concerned company or organisation. However, the appropriate next step can depend on whether the dispute is resolved and on the individual facts.

When Can a Consumer Complaint Be Considered?

If the issue remains unresolved, a consumer may consider the remedies available under the Consumer Protection Act, 2019, depending on the facts.

A Consumer Commission may provide legally appropriate relief in suitable cases, including relief relating to defects, replacement, refund, deficiencies in services, compensation for established loss or injury and other remedies permitted by law.

Refund or compensation is not automatic. The consumer’s allegations and claimed relief must be considered on the basis of the applicable law, facts and evidence.

Do Not Ignore the Limitation Period

Timing is important in consumer matters.

Under Section 69 of the Consumer Protection Act, 2019, a consumer complaint generally must be filed within two years from the date on which the cause of action arose, subject to the statutory provisions regarding delayed complaints where sufficient cause is established.

The exact limitation analysis may depend on the facts and important dates of the dispute. Consumers should therefore preserve their timeline from the beginning.

  • Deleting emails or WhatsApp communications.
  • Not saving the invoice.

One of the most important practical steps is to create a simple timeline showing the purchase date, payment date, delivery date, return date and refund-related communications.
