Hotel Charged Extra Money After Online Booking and Room Was Not Clean: Consumer Legal Remedies in India

This article is published by The Legal Warning India and written by Advocate Uday Singh.

You booked a hotel room online at a fixed price, but when you reached the hotel, the hotel demanded an additional amount. To make the situation worse, the room was not properly cleaned, the bathroom was unhygienic, or the accommodation was substantially different from what was promised at the time of booking.

This can become a consumer dispute, particularly where the hotel failed to provide the promised standard of service or imposed an additional charge that was not properly disclosed before the booking.

Under the Consumer Protection Act, 2019, a deficiency in the quality, nature or manner of performance of a service may fall within the statutory definition of “deficiency”. Depending on the facts, misleading representations or undisclosed commercial terms may also raise issues under consumer-protection law.

However, every additional hotel charge is not automatically illegal. The booking terms, taxes, cancellation conditions, room category, additional services and disclosures made before payment must be examined.

Hotel Charged More Than the Online Booking Amount – Is It a Consumer Dispute?

It depends on why the additional amount was charged.

For example, the situation can be different if the extra amount relates to:

  • Taxes that were clearly disclosed separately.
  • Extra services requested by the customer.
  • An additional guest or extra bed.
  • Charges clearly mentioned in the booking terms.
  • Damage or other charges specifically covered by the agreed terms.

On the other hand, a dispute may arise where a hotel demands an additional amount that was not properly disclosed during booking or refuses to honour the confirmed booking price without a valid contractual basis.

The booking confirmation, invoice, terms and actual bill should therefore be compared before making a legal allegation.

Room Was Not Clean – Can You Complain?

Yes, poor cleanliness can potentially become a service-quality issue depending on the facts.

For example, evidence may be relevant where:

  • Bedsheets were visibly dirty.
  • Bathroom was unhygienic.
  • Room contained garbage or previous guest’s belongings.
  • Room had a serious foul smell.
  • Basic promised facilities were not available.
  • The room was materially different from the description or category booked.

A minor inconvenience and a serious failure in the promised standard of accommodation may not be treated identically. The nature and extent of the deficiency, the booking terms and the evidence available will matter.

Take Photos and Videos Immediately

If the hotel room is dirty or substantially different from what you booked, preserve evidence before leaving the property or cleaning the room yourself, where reasonably possible.

Useful evidence may include:

  • Photographs of the room.
  • Photographs of dirty bedsheets or bathroom.
  • Videos showing the condition of the room.
  • Booking confirmation.
  • Online listing screenshots.
  • Payment receipt.
  • Hotel bill showing extra charges.
  • Messages exchanged with the hotel.
  • Complaints made to the booking platform.

Preserve original photographs, videos, emails and messages. Do not manipulate or edit evidence to change what actually happened.

What If the Hotel Demands Extra Payment at Check-In?

Do not immediately assume that every additional amount is unlawful. First ask the hotel for a written explanation and an itemised bill.

Check:

  • Original booking price.
  • Taxes shown during booking.
  • Room category.
  • Number of guests.
  • Extra-bed or guest charges.
  • Hotel’s published terms.
  • Any additional service requested by you.

If the additional amount was not disclosed and the hotel refuses to explain the basis of the charge, preserve the bill and written communication.

If possible, communicate with the hotel through email, the booking platform’s messaging system or another written channel so that a record exists.

What If the Hotel Refuses to Refund the Extra Amount?

First send a written complaint to the hotel and, where relevant, the online booking platform.

Your complaint should mention:

  • Booking ID.
  • Booking date.
  • Original amount paid.
  • Additional amount charged.
  • Reason given for the extra charge.
  • Condition of the room.
  • Relief you are requesting.

Depending on the facts, you may seek refund of an improperly charged amount and other legally permissible relief for an established deficiency in service.

Do not make exaggerated allegations. Keep the complaint based on the booking records, photographs, payment documents and actual events.

Can You Complain Against the Hotel Booking Platform?

It depends on the role of the platform in the transaction.

Sometimes an online platform primarily facilitates the booking while the hotel provides the accommodation. In other situations, the platform may have made representations, collected payment, offered a particular guarantee or undertaken specific obligations.

Therefore, before naming parties in a legal complaint, check the booking confirmation, invoice, terms and payment trail to understand who actually undertook which obligation.

What Legal Remedies May Be Available?

If the dispute is not resolved, a consumer may consider remedies under the applicable consumer-protection framework, depending on the facts.

Possible relief can include, where legally justified:

  • Refund of an improperly charged amount.
  • Compensation for established loss or injury.
  • Relief relating to deficiency in service.
  • Other appropriate directions available under consumer law.

A consumer complaint should be supported by evidence. A Consumer Commission does not automatically award compensation merely because a customer is dissatisfied.

Can a Legal Notice Be Sent to the Hotel?

A legal notice is not universally mandatory before every consumer complaint. However, depending on the facts, a written legal notice or formal demand can clearly record the grievance and the relief being sought.

Before sending a notice, it is important to verify the correct legal entity, booking records, amount claimed and supporting evidence.

Common Mistakes in Hotel Booking Disputes

  • Leaving the hotel without preserving photographs or videos.
  • Deleting booking confirmation emails.
  • Not taking an itemised bill.
  • Paying an extra amount without recording why it was demanded.
  • Relying only on verbal conversations.
  • Making unsupported allegations against the hotel online.
  • Failing to complain to the booking platform where appropriate.
  • Ignoring limitation and delaying legal action unnecessarily.

Frequently Asked Questions

Can I complain if the hotel charged more than the online booking price?

Potentially, depending on whether the additional charge was properly disclosed, contractually permitted or otherwise justified. The booking confirmation and final bill should be compared.

Can an unclean hotel room amount to deficiency in service?

Depending on the seriousness of the condition and the service promised, poor cleanliness may potentially constitute deficiency in service. Evidence of the actual condition is important.

What proof should I keep?

Keep the booking confirmation, payment proof, hotel bill, photographs, videos, messages, complaints and responses from the hotel or booking platform.

Can I ask for a refund?

Depending on the facts, a consumer may seek refund of an improperly charged amount and other legally permissible relief.

Conclusion

If an online hotel booking turns into a dispute because of an unexplained extra charge and poor room condition, do not rely only on verbal arguments.

Preserve the booking confirmation, advertised price, payment proof, final bill, photographs, videos and written communications. Ask the hotel for an itemised explanation and raise the grievance through the booking platform where appropriate.

If the dispute remains unresolved, the facts and documents can be evaluated to determine whether a consumer complaint or another legal remedy is appropriate.
