Can You File a Consumer Complaint Without an Invoice in India?

Many consumers believe that if they have lost the original invoice or bill, they cannot file a consumer complaint. This is not always correct.

An invoice is an important document because it can help prove the purchase, the amount paid, the seller’s details and the date of the transaction. However, the absence of an invoice does not automatically answer every question about whether a consumer can establish a valid claim.

The real issue is whether the consumer can establish the relevant transaction and allegations through genuine and legally relevant evidence available in the particular case.

Under the Consumer Protection Act, 2019, a consumer generally includes a person who buys goods or hires or avails services for consideration, subject to the statutory definition and exclusions. Online transactions are also covered within the statutory framework.

If you have lost your bill but still have payment records, order confirmation, emails, warranty details or other transaction evidence, those records may be relevant to your case depending on the facts.

Is an Invoice Important for a Consumer Complaint?

Yes. An invoice or purchase bill can be important evidence in a consumer dispute.

It may help establish:

  • The identity of the seller or service provider.
  • The date of purchase.
  • The goods or services purchased.
  • The amount charged.
  • The order or invoice number.

However, in some disputes, consumers may have other genuine records connected with the same transaction.

For example, an online purchase may leave a digital record consisting of an order confirmation, payment receipt, delivery confirmation and email communication. A service transaction may be supported by bank records, an agreement, booking confirmation or written communication.

Whether such evidence is sufficient will depend on the individual facts and the nature of the dispute.

What Can You Use If You Lost the Original Invoice?

If the invoice is unavailable, do not create, alter or fabricate a document. Instead, collect all genuine records connected with the transaction.

Depending on the facts, relevant records may include:

  • UPI transaction details.
  • Bank account statements.
  • Credit or debit card statements.
  • Online order confirmation.
  • Email confirming the purchase.
  • SMS transaction alerts.
  • Delivery confirmation.
  • Warranty registration records.
  • Service-centre job sheets.
  • Product registration details.
  • Relevant WhatsApp or email communication.
  • Seller or company account history.

These records should relate to the actual transaction. A payment record alone may not always explain what was purchased, while an order confirmation alone may not always establish the complete payment history. Therefore, connecting multiple genuine documents can sometimes provide a clearer factual record.

Can You Ask the Company for a Duplicate Invoice?

In many situations, consumers may first try to obtain a duplicate invoice or transaction record from the seller, manufacturer, online platform or service provider.

For online purchases, invoices may also be available through the customer’s account, order history or registered email address.

Before filing a complaint, check:

  • Your registered email account.
  • Your online shopping account.
  • The company’s mobile application.
  • Your payment history.
  • Your bank statement.
  • The seller’s customer support system.

If the seller or company refuses to provide information, preserve your written request and the response received.

What If You Paid in Cash and Lost the Bill?

A cash transaction without an available invoice can create practical evidentiary difficulties.

In such cases, other genuine evidence may become particularly important. Depending on the circumstances, relevant material may include written communication, warranty registration, service records, delivery records or other documents connected with the transaction.

However, every case will depend on its own facts. If there is very little evidence connecting the consumer with the alleged transaction, proving the claim may become more difficult.

Can WhatsApp Messages Be Used as Evidence?

Relevant WhatsApp chats, emails and other electronic communications may be important in establishing what was discussed between the consumer and seller or service provider.

For example, messages may show:

  • Confirmation of payment.
  • Details of the product or service.
  • A promise of delivery.
  • An acknowledgement of a defect.
  • A promise of refund or replacement.

Electronic records should be preserved carefully in their original form wherever possible. Their admissibility and evidentiary treatment depend on the applicable law, procedure and facts of the particular proceeding.

For current legal matters, the applicable evidence-law framework includes the Bharatiya Sakshya Adhiniyam, 2023.

What Should You Do Before Filing the Complaint?

Before approaching a Consumer Commission, organise your available evidence in chronological order.

A simple timeline may include:

  1. Date of purchase or booking.
  2. Date and mode of payment.
  3. Date of delivery or service.
  4. Date when the problem was discovered.
  5. Date when you first contacted the company.
  6. Company’s response.
  7. Refund, repair or replacement details, if applicable.

This can make it easier to understand the dispute even where one particular document, such as the original invoice, is unavailable.

It is also important to identify the correct seller, company or service provider against whom the complaint is proposed to be made.

Common Mistakes Consumers Should Avoid

  • Creating a fake invoice after losing the original.
  • Editing screenshots to change transaction details.
  • Deleting original emails or messages.
  • Failing to download available order records.
  • Not checking bank or UPI transaction history.
  • Relying only on verbal conversations.
  • Waiting too long before considering the applicable limitation period.
  • Naming the wrong company or seller as the opposite party.

The Consumer Protection Act, 2019 generally provides a limitation framework for consumer complaints, including Section 69. The applicability of limitation depends on when the cause of action arose and other facts of the individual matter.

When Can Missing Documents Become a Serious Problem?

A missing invoice may become more significant where there is no other reliable record connecting the consumer with the alleged purchase or payment.

For example, a dispute may become more difficult where:

  • There is no invoice.
  • There is no payment record.
  • There is no order confirmation.
  • There is no written communication.
  • The identity of the seller is unclear.

In such situations, the available facts and evidence should be carefully assessed before making legal allegations.

Can I file a consumer complaint if I lost my bill?
