Cheque Bounce Mein Police FIR Ya Court Case? Prayagraj Ki Legal Reality Samjhiye
Cheque bounce hone ke baad Prayagraj (Allahabad) mein sabse pehla sawal log ye puchte hain:
“Police FIR karni chahiye ya seedha court case file karein?”
Galat jagah complaint karne se:
- Time waste hota hai
- Case weak ho jata hai
- Police complaint reject ho sakti hai
Is article mein hum Prayagraj ki ground reality ke hisaab se batayenge ki cheque bounce ke case mein FIR kab hoti hai aur kab sirf court ka rasta hota hai.
Information is based on news reports, court practice, aur publicly available legal principles.
Cheque Bounce Kya Hota Hai? (Simple Samjhiye)
Jab kisi vyakti ya company dwara diya gaya cheque:
- Insufficient funds ke kaaran
- Account band hone ke kaaran
- Payment stopped hone par
bank se return ho jata hai, to ise Cheque Dishonour / Cheque Bounce kaha jata hai.
India mein iska main legal action Negotiable Instruments Act, Section 138 ke under hota hai.
Sabse Bada Confusion: FIR Ya Court Case?
Prayagraj mein aam taur par log pehle police station jaate hain, lekin:
Har cheque bounce case mein FIR nahi hoti.
Police aksar ye kehkar mana kar deti hai:
- “Ye civil / court matter hai”
- “Court jaaiye”
Aur ye baat kaafi had tak sahi bhi hoti hai.
Cheque Bounce Mein Police FIR Kab Ho Sakti Hai?
Police FIR tab possible hoti hai jab:
- Cheque jaan-boojh kar fraud ke iraade se diya gaya ho
- Shuru se hi paise dene ka intention na ho
- Fake identity / forged cheque ka use hua ho
- Multiple logon ke saath cheating hui ho
Sirf paisa na milna ya cheque bounce hona automatic FIR ka reason nahi hota.
Prayagraj Mein Cheque Bounce Ka Correct Legal Process
Step 1: Legal Notice Bhejna (30 Din Ke Andar)
Cheque return hone ke 30 din ke andar ek legal notice bhejna mandatory hota hai.
Step 2: 15 Din Ka Waiting Period
Agar notice ke baad 15 din mein payment nahi hoti, tab case banta hai.
Step 3: Court Mein Case File Karna
Case Judicial Magistrate Court, Prayagraj mein file hota hai.
Ye process Section 138 NI Act ke under hota hai, FIR ke through nahi.
Police Kyun FIR Likhne Se Mana Kar Deti Hai?
Police ka practical view hota hai:
- Cheque bounce ek statutory offence hai
- Iske liye special court process bana hai
- Har case mein criminal intention prove nahi hota
Isliye Prayagraj police aksar complainant ko court jaane ki salah deti hai.
Galat Jagah Complaint Karne Ka Nuksaan
- Limitation period miss ho sakta hai
- Notice ka time nikal jata hai
- Opposite party ko advantage mil jata hai
Isliye sahi legal strategy shuru se zaroori hai.
Prayagraj Ke Clients Ke Liye Important Salah
- Direct FIR ke liye police ke chakkar na kaaten
- Cheque bounce notice bina delay bhejein
- Local advocate se drafting karwayein
- Proof aur documents sambhal kar rakhein
