Police FIR Procedure in Prayagraj: BNSS 173, SP Complaint & Current Legal Guide

Prayagraj में FIR procedure समझते समय 1 July 2024 के बाद लागू BNSS framework को ध्यान में रखना जरूरी है। यह guide cognizable offence की information, FIR copy, police investigation और refusal की स्थिति में SP/Magistrate remedies को सरल भाषा में समझाती है।

FIR क्या है?

FIR सामान्यतः cognizable offence की पहली सूचना के आधार पर police record की जाने वाली report है। हर complaint FIR में convert नहीं होती; offence की nature और applicable law देखना जरूरी है।

Prayagraj में FIR देने का सामान्य तरीका

  1. घटना के material facts, date, place और available evidence तैयार रखें।
  2. Police station में information oral या writing में दें; BNSS Section 173 electronic communication का भी statutory framework देता है, subject to applicable formalities.
  3. Information/FIR number और copy सुरक्षित रखें।
  4. FIR के बाद police investigation statutory procedure के अनुसार हो सकती है।

FIR की Copy

BNSS के applicable framework के अनुसार informant/victim को FIR की copy देने का statutory provision है। Copy में FIR number, date और recorded provisions जैसी details verify करें।

अगर Police FIR Record न करे

  1. Police station को दी गई complaint और receiving/acknowledgement सुरक्षित रखें।
  2. BNSS Section 173(4) के framework के अनुसार information का substance Superintendent of Police को writing/post के माध्यम से भेजा जा सकता है।
  3. यदि आगे Magistrate-directed investigation की जरूरत हो, तो BNSS Section 175(3) relevant provision है; Section 173 और Section 175(3) को एक ही provision न समझें।

156(3) CrPC का Current Position

नए criminal procedure framework में पुराने CrPC section numbers को current provision मानकर article या application तैयार करना सही नहीं है। Magistrate-directed investigation के लिए BNSS Section 175(3) relevant statutory provision है।

क्या हर complaint पर FIR होती है?

नहीं। Cognizable और non-cognizable offences के लिए अलग statutory procedure हो सकता है। Purely civil dispute को criminal case में बदलने के लिए आवश्यक criminal ingredients अलग से मौजूद होने चाहिए।

FIR और Arrest अलग हैं

FIR registration अपने आप arrest का automatic आदेश नहीं है। Arrest की legality और necessity facts तथा BNSS के applicable provisions पर depend करती है।

Online Complaint

UP Police के available online complaint/reporting channels का उपयोग category और service availability के अनुसार किया जा सकता है। Online submission की acknowledgement/copy सुरक्षित रखें।

Common Mistakes

  • Old CrPC sections को current law की तरह लिखना।
  • Complaint में unsupported allegations या fabricated evidence देना।
  • Police complaint और SP complaint की copies सुरक्षित न रखना।
  • FIR registration को automatic arrest समझना।
  • Pure civil dispute में criminal provisions बिना ingredients के जोड़ना।

FAQs
