Bank Account Frozen After Cyber Complaint? How to Respond and Get It Unfrozen

Has your bank account been frozen, lien-marked or debit-restricted after a cybercrime complaint? If you believe your transactions were genuine, do not panic. A freeze during an investigation does not by itself mean that you have been found guilty of cyber fraud.

The first step is to find out why the account was restricted, which authority requested the action and which transaction is under question.

Why Can a Bank Account Be Frozen After a Cyber Complaint?

During a cybercrime investigation, the police may trace the movement of disputed money through different bank accounts. If your account appears in that transaction trail, the account or a particular amount may be restricted while the transaction is verified.

This can happen even when the account holder claims that the transaction was completely legitimate.

First Find Out: Freeze or Lien?

Contact your bank and ask for written information, wherever available, regarding:

  • Whether the entire account is frozen.
  • Whether only a particular amount is under lien.
  • Whether debit transactions are blocked.
  • The requesting authority or cyber cell.
  • Reference/complaint number, if available.
  • The disputed amount and transaction details, if disclosed.

This information helps you approach the correct authority instead of repeatedly contacting the wrong department.

Important: I4C Does Not Itself Freeze Bank Accounts

The Indian Cyber Crime Coordination Centre (I4C) has clarified that it does not itself freeze or lien-mark bank accounts. Such action may be taken by the concerned investigating agency or bank under the applicable process.

Therefore, identify the actual investigating authority connected with your account restriction.

What Should You Do Immediately?

  1. Ask the bank for freeze/lien details.
  2. Obtain your complete bank statement.
  3. Identify the disputed transaction.
  4. Collect proof showing the source and purpose of the money.
  5. Prepare a factual representation to the concerned cyber/police authority.
  6. Keep acknowledgement of every submission.

  • UPI/payment records
  • Invoices and receipts
  • Contracts or agreements
  • Salary records
  • Business records
  • WhatsApp chats and emails
  • Payment confirmations
  • Relevant police/bank communication

Your objective should be to explain the source, purpose and transaction trail of the disputed money.

Can You Submit a Representation to Cyber Police?

Yes. If your account has been restricted in connection with a cyber complaint, you may submit a written representation explaining the transaction and attaching supporting documents.

The representation can request the authority to:

  • Verify your transaction and documents.
  • Consider your explanation.
  • Identify the disputed amount, where possible.
  • Review whether continued restriction is necessary.
  • Consider release of legitimate funds according to law.

Do not make unsupported allegations or provide false explanations.

What Does Current Law Say?

For new criminal procedural matters, the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) applies from 1 July 2024.

BNSS Section 106 deals with seizure of certain property in specified circumstances, while Section 107 deals with attachment, forfeiture or restoration of property derived from criminal activity, subject to the statutory procedure.

The exact legal basis for a bank restriction depends on the facts, investigation and nature of the action taken. It is therefore incorrect to assume that every cyber complaint automatically gives unlimited authority to freeze an entire account indefinitely.

What If Only a Small Amount Is Disputed?

If only a particular transaction or amount is connected with the complaint, clearly identify it in your representation and explain the source of the remaining legitimate funds.

You may request appropriate review of the restriction, but whether the entire account can be released depends on the investigation and applicable legal process.

What If the Bank Does Not Resolve the Issue?

First use the bank’s internal grievance mechanism and keep proof of your complaint.

If the issue concerns banking service and falls within the applicable RBI Ombudsman framework, the eligible complaint route may be considered after approaching the bank. However, an Ombudsman complaint is not a substitute for challenging an active police/cybercrime investigation.

What If Cyber Police Do Not Respond?

Keep proof of your representation. Depending on the facts, further steps may include:

  • Representation to a senior police authority.
  • Further written request for status/clarification.
  • Bank grievance proceedings.
  • Appropriate application before the competent Court.
  • Other legal remedy based on the circumstances.

The correct Court and procedure depend on the authority involved, jurisdiction, stage of investigation and legal basis of the restriction.

Do Not Make These Mistakes

  • Do not delete WhatsApp chats or payment records.
  • Do not edit or manipulate screenshots.
  • Do not create false invoices or documents.
  • Do not threaten the complainant or police officials.
  • Do not ignore a cyber-cell notice.
  • Do not try to bypass the restriction through another person’s account.
  • Do not post unsupported allegations on social media.

Can I recover access to my salary account?
